How can I collect child support from a partner who lives outside the United States?
If you have a child, it's likely that you'll need to request child support at some point. If your child has a parent who lives outside of the United States and is not a U.S. citizen or permanent resident, collecting child support can be tricky. Child support laws differ from country to country, and there are only a few ways to collect support when your ex-spouse lives out of the country. Some countries will not enforce an American court order for child support on the grounds that they do not recognize international marriages.
In order to get your partner to pay up, you must first find them in their home country and serve them with papers to notify them of the court order. Once you do this, they have 30 days to respond with either an appeal or payment. If they decide to appeal, you'll need to hire a lawyer in the country where your ex-spouse lives—you can't represent yourself in any foreign courts. You must also be able to prove that your ex-spouse owns property in the country where they live, so keep all records of your investments together so that you can access them if needed.
If your partner does not respond within 30 days, forward all records to the U.S. State.
If you're seeking child support from a parent who lives outside the United States, you may be at a bit of a loss as to how to go about collecting that money. You would need to contact an attorney in the country where the other parent is living.
