How can someone sign custody of a child without going to court?

No. Not really. Not if it’s going to be legal, valid, and binding. When a person doesn't want to go through the courts to sign custody of a child, they can sign a written agreement with the other parent, which is a document that states who has legal custody of the child. A court may not honor this type of document. This is different than having physical custody of the child. If you would like to have legal and physical custody of your child, you must go to court and file for it. Before receiving physical custody, however, you must have legal custody first.
