If I have no parental rights, do I pay child support?

If you have no parental rights, you are not legally obligated to pay for the child's upbringing. Sometimes, you can be a putative parent and a court or an administrative order can be issued that makes you pay child support. Basically, the court can still order you to pay your fair share of the child support if only one parent has parental rights and is receiving government aid. However, if the other parent has sole custody, then you might not have to pay any child support. The specific details of your case matter. In most cases, however, both parents are given some parental rights, and unless they agree otherwise and the court orders otherwise, both parents are responsible for paying for the costs associated with raising the child.

If you aren't paying child support, it might be because you don't have any parental rights. It's possible to have a child without being recognized as a legal parent, which means that your child can live with someone else and you wouldn't have to pay regular child support. However, if you are listed on the birth certificate and have acknowledged paternity, you may have some obligations toward your child.

If you have specific questions about how this works, please call our office for an initial consultation. We might be able to help you.
