Is a person still required to pay child support if their ex remarries and the new spouse adopts the children?
The short answer is no.
In most cases where an adult wishes to adopt a stepchild, it can be useful to consult with an attorney beforehand to find out how this will affect things like inheritance rights and what steps should be taken to protect them. If you're currently involved in a custody dispute over your stepchildren, an attorney can help you understand what your rights are as a stepparent and how you can best protect yourself from being held financially liable for something you no longer have any control over.
Sometimes, couples end up in an unpleasant situation after a divorce: one parent feels they are paying too much child support to the other parent. While there are many factors that may determine whether or not a person has to pay child support if one of the parents remarries and the new spouse adopts the children, the requirement for child support could be lifted.
Note: A person who has joint custody of their child is not a parent who is remarried and whose child is adopted by the spouse. A first instance is a person with legal custody of the child, and the second instance is a stepparent.
