Not in the state of Utah. Some states have a requirement that each spouse has independent counsel. If each element is not met, the prenup is not valid. A simple binding prenup is possible if your state allows it, but even then you may want a lawyer to help you anyway. It's important to note that there are two basic types: "marital settlement agreements" and "prenuptial agreements." The difference is the first one can be drawn up without attorneys and does not require court approval, while the second one does.
