What is a prenuptial agreement?

A prenuptial agreement is a contract signed before marriage that legally establishes the division of property and finances should the marriage end in divorce. It's also known as a prenup. A prenuptial agreement can also be called a premarital agreement, antenuptial agreement, or marriage contract.

The term "prenup" is often frowned upon by people who don't like the idea of planning for something that perhaps shouldn't have to be planned for at all—a happy marriage that lasts forever. But if you're contemplating marrying someone who has a lot more money or assets than you do, it might make sense to protect your own interests by having a conversation about signing a prenup together. You could even suggest writing one up together to make the process collaborative and therefore less contentious.

To be clear, a prenup isn't about predicting (or betting on) the future; it's about safeguarding yourself from financial insecurity in case things don't work out with your spouse. Even if you sign one, you're not doomed to divorce; plenty of couples use one and stay happily married for life. However, if you want to write up an agreement before tying the knot, there are some things to consider.

It's important to note that a prenup is not the same thing as a will. A will goes into effect after you pass away and determines how your belongings are distributed. A prenup, on the other hand, is designed to regulate your assets during your lifetime.
