When does a relationship become a common law marriage?

In Utah, it never happens because Utah doesn’t recognize common law marriages. However, there still might be a lawsuit for a “marriage like relationship” - you’d need to speak with a lawyer about that. A common law marriage is a legally recognized marriage between two partners who are in an ongoing, committed relationship. No papers have been signed or licenses have been applied for. A common law marriage begins with a verbal (or sometimes written) agreement between the couple about the state of their relationship and then continues with that same kind of commitment to one another over time.

When does a relationship become a common law marriage? There's no way to set a concrete date or time period, but these circumstances can help you determine whether you're in a common law marriage:


-          You've lived together as a couple for at least three continuous years; or


-          You've been in an exclusive, committed relationship for at least three continuous years and you represent yourselves to family, friends, and the general public as being married; or


-          You've had a child together and both people agree to be married.

In addition, if either partner has children from previous relationships, it's common for them to be included in the new relationship. If that includes support payments or custody considerations, that can also strengthen your case as far as proving common law status goes.
