If a person had no will, does their estate have to go through probate?

Maybe. Usually. If they had a trust properly funded - no. Contact a lawyer to be sure. Probate is a complicated and time-consuming process, and it's best to avoid it if at all possible. In the absence of a will, probate can be avoided by designating a person as the executor of the estate. This person would then manage the estate and distribute its assets according to state law. If you want to pass your assets to your heirs without going through the court system, ask yourself, who do you trust more with your final wishes: yourself or a judge?
