When does a house go to probate?

 A house that is left to an individual in a will can go through probate when the person who left the house passes away without having a will. The property is then put up for sale with a real estate agent or broker, and the money goes to pay any outstanding debts owed by the deceased individual, taxes, and then the remainder after costs and fees is issued to the heirs of the estate. Probate can be avoided if the owner of the property has a living trust, which is a legal document that allows a person to transfer his or her property after death to a trust managed by someone else. The trust survives while avoiding probate altogether.
