Why is probate necessary?
Probate is necessary in order to settle an estate after someone dies because they can’t sign the legal documents to transfer ownership of items. When a person dies, their property needs to be transferred from their name to the name of the person or people who are going to inherit it. You may have heard of "probate court" or "probate proceedings." This is that court process that transfers the title of the property from one person to another.
This is necessary because when you die, your state has a legal requirement to figure out what happens with your property and assets. If you don't write a will, you're considered to have died "intestate" (which means without a will). In that case, there's a set of rules that determines how your property is divided up.
The probate process can take a while, so it's important to get started as soon as possible after someone dies. That's why it's best if the person who is going to be in charge of the probate process (the "personal representative") knows about the death right away so they can start working on it right away. If you don't tell anyone else about the death for a long time, then nobody knows about it except for you—and if you're not careful or forgetful, then you might make mistakes.
