If a pregnant woman and a man get a divorce, would there be a custody battle over the unborn baby?

Yes. There is and are custody battles over unborn children all the time.

If the mother is married to someone else, she and her husband together are considered the legal parents of an unborn child. However, if she is not married to someone else, then paternity is not established until after the child is born. In this case, the father must take legal action to establish paternity before the mother gives birth to be considered a legal parent. If he doesn't act fast enough, he will not be able to obtain custody or visitation rights; however, if he does act quickly enough, then he could try to obtain custody or visitation rights.

Whether or not a father can get custody of an unborn child depends on his relationship with the mother. For example, if there was just one party involved in getting a sperm sample from him (such as through consensual sex), then he may not have any parental rights at all. If there were multiple parties involved in getting a sperm sample, then he might have some parental rights.
